CANADA IMMIGRANT INVESTOR PROGRAM

The Immigrant Investor Program grants an investor, spouse and children under 22, a Canadian permanent residency via investment of CAD 1.2 million in Investissement Québec (IQ) IQ was established in 1998 under an Act passed by the National Assembly of to favour investment in by -based and international companies. The investment is made through a financial intermediary authorized to participate in the QIIP. The financial intermediary offers the possibility of financing the investment for a one-time loan payment of CAD 330,000. This prescribed investment for a five-year term is guaranteed by the Government of Canada. At the end of the five-year term, the financial intermediary will reimburse the investor CAD 1.2 million without interest, within 30 days.

Immigration under QIIP is a shared jurisdiction between the Government of Québec and the Government of Canada. Québec is responsible for selecting investors who wish to settle in its territory. If selected, applicants will receive a Certificat de sélection du Québec (CSQ – Québec Selection Certificate), an official immigration document issued by the Ministère de l'Immigration, de la Diversité et de l'Inclusion (MIDI). Canada is responsible for the admitting investors to its territory. To be admitted as a permanent resident, selected investors and dependents must apply for permanent residency to Immigration, Refugees and Citizenship Canada (IRCC) and pass the required medical examination and security screenings. The Canada Start Up Visa Program grants an investor, spouse and children under 22, a permanent residency for Canada upon endorsement by a Designated Organization. Designated Organizations are business groups approved by to support possible start-ups through the Start-Up Visa Program. Start-up concepts are assessed on the potential of the proposal and likelihood to succeed. At the time of application, the investor must be owner of a qualifying start-up concept. ActiveAvenues works with legal representatives and business consultants to identify qualifying start-up concepts and to apply to a Designated Organization for a letter of support on behalf of the investor. Permanent residency through the Start Up Visa Program is conferred at the federal level.

Investors are considered tax resident in Canada if they are physically present in Canada for at least 183 days in the calendar year. Tax residents are taxed on worldwide income. Non-tax residents are taxed on income derived or sourced in Canada. Income is taxed at progressive rates at the federal level. Canada has no formal inheritance tax, however, a deceased taxpayer generally is deemed to have disposed of all property owned immediately before the time of death at fair market value.

A Canadian permanent residency grants freedom of movement, settlement and employment in Canada. Once citizen of Canada, investor can expand work to the US under the NAFTA agreement. Canada offers a wide range of social services and benefits including free medical services to its permanent residents and citizens and free education up to grade 11. Higher education is also subsidized. Permanent residency in Canada must be renewed every 5 years. To maintain PR the investor must reside in Canada at least 730 nonconsecutive days in 5 years and for citizenship, investor must reside in Canada at least 1095 days in 4 years preceding application.
